About the TAKE IT DOWN Act
The TAKE IT DOWN Act (Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act) is a federal law signed on May 19, 2025, that requires online platforms to remove non-consensual intimate images within 48 hours of receiving a valid takedown notice.
This law covers both real and AI-generated intimate visual depictions, including deepfakes and any content that appears to depict an identifiable individual without their consent.
Our Commitment
Kwiki AI is committed to protecting individuals from non-consensual intimate imagery. While all content on our platform is AI-generated and not intended to depict real persons, we recognize that:
- AI-generated content may inadvertently resemble real individuals
- Deepfake technology can be misused to create non-consensual content
- Any individual has the right to request removal of content that appears to depict them
- We take all removal requests seriously and act swiftly
How to Submit a Takedown Request
To request removal of content under the TAKE IT DOWN Act, please provide the following information:
Required Information:
- Identification of Content: Provide the URL or specific description of the content you want removed. Include video ID, timestamp, or any other identifying information.
- Your Identity: Your name and confirmation that you are the individual depicted (or authorized representative).

Good Faith Protections
Under the TAKE IT DOWN Act, Kwiki AI is protected from liability for good faith removal of content in response to valid takedown requests. This means we will err on the side of caution and remove content when there is reasonable belief that it may be non-consensual.
We do not require proof of identity beyond a reasonable good faith statement, as we prioritize the safety and privacy of potential victims.
Additional Protections
Beyond the TAKE IT DOWN Act requirements, Kwiki AI also:
- No Real Persons Policy: We do not knowingly host content depicting real individuals
- AI-Only Content: All content is sourced from AI generation platforms
- Proactive Screening: We screen content to identify potential deepfakes or realistic depictions
- User Reporting: Users can report suspected non-consensual content directly from our platform
- Law Enforcement Cooperation: We cooperate fully with law enforcement investigations
AI-Generated Deepfake Protections
While all content on Kwiki AI is AI-generated, we recognize that deepfake technology can be misused to create non-consensual intimate images. We employ specialized protections against AI-generated deepfakes:
Deepfake Detection Technology
- Synthetic Media Detection: AI models trained to identify deepfake artifacts, inconsistencies, and generation signatures
- Facial Recognition Screening: Comparison against databases of public figures, celebrities, and known individuals
- Reverse Image Search: Cross-referencing against internet images to detect real person lookalikes
- Metadata Analysis: Inspection of generation prompts, model parameters, and source files for real person references
Celebrity & Public Figure Protection
- Proactive blocking of content resembling identifiable celebrities, actors, musicians, and influencers
- Database of protected identities automatically screened against all content
- Immediate removal upon notification from rights holders or authorized representatives
- Cooperation with talent agencies, publicists, and legal counsel for public figures
User Generation Controls
For content created using Kwiki AI tools (if applicable):
- Prompt Blacklisting: Prohibition on prompts referencing real names, celebrities, or identifiable individuals
- Training Data Restrictions: AI models trained exclusively on synthetic datasets without real person likenesses
- Pre-Generation Screening: Prompts analyzed for real person references before content generation
- Post-Generation Review: Generated content scanned for resemblance to real individuals before publication
Hash-Based Prevention System
Once content is removed as non-consensual:
- Content Hashing: Removed content is hashed using PhotoDNA, PDQ, and perceptual hashing algorithms
- Upload Blocking: Hash database prevents identical or near-identical content from being re-uploaded
- Variant Detection: Similar content (cropped, rotated, color-adjusted) blocked using perceptual matching
- Database Sharing: Hashes shared with NCMEC NCII Database and other platforms (with user consent)
This prevents bad actors from re-uploading removed content or evading removal through minor edits.
Penalties for Violations
The TAKE IT DOWN Act imposes significant penalties for non-compliance:
- Civil penalties up to $53,088 per violation
- Federal Trade Commission enforcement actions
- Potential criminal liability for knowingly hosting non-consensual content
Kwiki AI takes these obligations seriously and maintains strict compliance procedures.
